### Sam Bankman-Fried, founder and former CEO of fallen crypto exchange FTX, was ordered to jail on Friday. U.S. District Court Judge Lewis Kaplan revoked his bail after finding probable cause in at least two instances of witness tampering.

Prosecutors said that Bankman-Fried leaked private diary entries of his ex-girlfriend, Caroline Ellison, to a New York Times reporter. Ellison was the former CEO of Alameda Research, a hedge fund co-founded by Bankman-Fried that supposedly received funds from FTX.  She is expected to testify against SBF in court after pleading guilty to fraud charges. 

A July 20 article published in The New York Times contains passages from Ellison’s personal Google documents where she described feeling “unhappy and overwhelmed” because of her job. The article also mentioned Ellison felt “hurt/rejected” because of her breakup with Bankman-Fried.

After the article was posted, prosecutors filed a formal request before the judge to modify Bankman-Fried’s bail terms. According to the request, the documents were released to “portray a key cooperator testifying against him in a poor and inculpatory light.” Prosecutors further argued that it was an attempt to discourage other witnesses from testifying. 

Mark Cohen, Bankman-Fried’s lawyer, said that Bankman-Fried was only defending himself and that the U.S. Constitution’s First Amendment gives Bankman-Fried the right to speak to the press. 

Judge Kaplan rejected these arguments. He noted that Bankman-Fried previously attempted to influence a witness by asking an FTX U.S. affiliate lawyer to “vet things with each other.”

During the hearing, Judge Kaplan said that SBF had “gone up to the line over and over again.” Judge Kaplan also denied the defense’s request to delay Bankman-Fried’s detention while they filed an appeal.

Bankman-Fried had been living with his parents in their home in Palo Alto, California since his arrest in December last year. Bankman-Fried will be going to trial on Oct. 2 where he is accused of stealing billions in FTX customer funds.
