A Netherlands court ordered Tornado Cash developer Alexey Pertsev to remain in jail until Feb. 20 because he is a flight risk. Pertsev has been in detention since August 10. 



He was arrested in Amsterdam by the Netherlands’ Fiscal Information and Investigation Service (FIOD) just two days after the U.S. Treasury Department sanctioned Tornado Cash. The crypto mixer is allegedly linked to North Korean hackers and helped with over US$1 billion in illicit transactions. 



Pertsev is accused of facilitating money laundering by developing the app. The FIOD began its investigations of Tornado Cash in June, saying that it did not check whether the origins of the digital assets come from criminal activities. 



Lawyers for Pertsev argued that Tornado Cash is a decentralized protocol, which meant that Pertsev had little control over it. However, the Dutch publish prosecutor said that Tornado Cash is the same as PepperSec, a company that Pertsev worked for with developers Roman Semonov and Roman Storm.



Keith Cheng, Pertsev’s lawyer, told media outlet CoinDesk that the decision was disappointing and that the judges did not fully understand the matter. According to him, “it’s clear to us that these judges are not as familiar with the subject matter as they should be.”



Pertsev’s arrest has drawn widespread attention, with protests held in Amsterdam and a tweet from Edward Snowden questioning Perstev’s treatment compared to the executives of beleaguered crypto exchange FTX.
